Dear Kay and Steve.
 
As one of the trustees and the manager  it has fallen to me to write to you about your sheep wandering on to the ELF Trust land.

On the 40 acres that I manage there are two areas under vegetable and soft fruit production that are vulnerable to any animal that enters whether to graze or just wander around. In any event, members of the trust do not want you to cultivate the idea that we will neither continually tolerate your sheep grazzing even non cultivated vegetation  nor causing damage to or disturbing any other valubale asset.

My regular presence has minimised the damage on the three last occasions and I have not asked for, nor have you offered any, sort of compensation.

Would you therefore please write to the trust afirmning that you intend to take better control of your sheep, explaining how you intend to do so,  and assure us that if it happens again you are preparted to financially or otherwise recompense the users of the ELF land for damage, time spent and stress aquired as a consequence of you failing to contain your animals.

I would appreciate a  reply in writing, within 14 days of your receipt of this letter, with an outline of your views and intentions. Alternatively you may reply via the website @ http://eu.rogerlovejoy.eu/elf.php using either the contact link or by responding to the post  Black Sheep

To clarify the position:
The onus is not for the trust to protect its property from sheep or other livestock but to the 'owner' of the animals to provide adequate means to restrain them and not allow trespass and damage.

I enclose a copy of the relevant parts of the 'Animal Act 1971' for clarity

I have highlighted those parts that I consider to be of specific relevance.
