ELF Trust Declaration, 19th June, 1993


PREFACE

This Declaration of Trust made on the 21st of September 1992 and re-written on the 19th. June 1993, recognises the Earth as a centre of development for life as we know it.

Our capacity for development being ensured by the myriad of forms within our knowledge. Therefore the destruction of any form is to be considered carefully due to the possible loss of variety

AIMS:

To satisfy energy requirements in an increasingly ecological manner, e.g.

  1. Growing of our food organically.
  2. Producing fuel for heating and cooking.
  3. Increasing the energy efficiency of housing.
  4. Self-sufficient recycling to replace waste disposal
  5. Generation of electricity for modern technology.
  6. Consideration to clothing and transportation,
  7. Self education to predominate teaching.

OBJECTS:

  1. To use available funds to buy land freehold and to live thereon in accordance with the above aim and any trust rules that may apply.
  2. To protect the land from individual ownership and to use a system of agriculture based on tree products to help satisfy all sections of the aim.
  3. Where our experience is valid and useful , to be open to communicate this to others freely and gratis.

RULES:

1) The trust account to be named ELF.

2) Beneficiaries are entitled to the produce of one acre of land each and may exercise their right to walk over any land held by the Trust taking due care in the process.

3) The sale of part or all of trust land is conditional on the proceeds being used to buy other land with the same aims. All conveyancing costs and any other matters are to be paid from the trustees, and where agreed, the beneficiaries' private resources.

4) Beneficiaries will be entitled to the use of parts of the land for forest agriculture of size and nature to be agreed with other interested persons.

5) Trustees may resign giving notice in writing at least a period of two full moons prior. On resignation their names will be removed from any accounts held in trust and monies they deposited there by way of themselves or others will remain the property of the Trust. Their rights as beneficiaries, if any, will continue.

6) Animals are only to be taken on to trust property if they are in immediate danger or suffering some attendable physical injuries whence passed they will be returned wherefrom they came.

7) To raise monies to purchase land by donation or earnings.

8) Forest agriculture means herein a minimum of land held by the Trust being either 2/3 wild habitat or 2/3 managed forest.

9) Each person shall have responsibility of one acre of land, presently in U.K.

10) All decisions are to be made unanimously by trustees.

12) Benefactors (Wrong Word - should be BeneficiariesAmended 13th September, 2002) over 18 will be required to further the monies for the purchase of one further acre of land within three years of a notice from the trustees in writing.

13) By virtue of Trust any person depositing any monies to the Trust forfeits their ownership of said monies henceforth and shall be entitled to a beneficiary status to the extent of the produce from one acre of land for the rest of their life and shall be entitled to pass their right to any named person.

14) Any person not contributing as per rule 12 who may be a trustee and a beneficiary has only nominees control over the Trust funds and land as trustees until they cease to be such and as beneficiaries only to the extent of the produce from one acre of land for a time decided by the trustees.

15) Other than the founding trustees any person agreeing with the aims and objects may become a trustee with the unanimous agreement of either all existing trustees or all beneficiaries.

16) Meetings of trustees and beneficiaries to be held at least seasonally by request of any member for day to day running. At other times as suitable to change Trust rules (all trustees must be present).

17) Minutes to be kept at meetings.

18) Account book documents deeds etc. are kept by Roger Lovejoy.

19) If Trust is wound up the beneficiaries shall take ownership of the land as per the trustees agreement.
